Kishorchandra’s detention under NSA not revoked, Manipur govt tells High Court

NSA detention of journalist W Kishorchandra, who was released on July 23, 2021 by an interim order of the High Court, has not been revoked till now and the case is still pending, the Manipur Government has informed the High Court of Manipur.

The Manipur government made the clarification on an affidavit filed by Deputy Secretary (Home), Government of Manipur Th Charanjeet Singh in opposition to writ petition filed by Kishorchandra’s wife Elangbam Ranjita.

However, regarding Erendro Leichombam, another NSA detenu on similar charge, who was released on 19-07-2021 as per an interim order of the Supreme Court and Home Department had also revoked the NSA detention order, said the affidavit.

In the affidavit, the Manipur government alleged that Kishorchandra is habitual offender committing offences that intend to cause fear and alarm to the public tranquillity, with a potential to incite any class or community of person to commit offences against other class or community, promoting enmity, hatred or contempt or incite or attempt to incite disaffection towards the Government established by law in India.

Kishorchandra @ Wangkhemcha Wangtoi was detained under the National Security Act, 1980 by the District Magistrate, Imphal West, Manipur on November 27, 2018 for posting “four video clips wherein he used unconstitutional and invective words (F..K YOU, SAKTHU) a number of times and with middle finger gesture, blame the existing Government both the State and the Union, for the policy and programmed under the supervision of the Prime Minister of India, Shri Narendra Modi in connivance with RSS.”

After release from Jail, Kishorechandra worked as an Associate Editor in the Frontier Manipur (an online news portal) since August, 2020. On 20-09-2020 he was again arrested in connection with FIR NO. 14(9)2020 Senapati U/S 124-A/153A/500 IPC & 3(1)(R) SC & ST POA Act, 1989 for posting a communally derogatory remark against Maram Tribe in the social Media i.e. on the same Facebook Account and remanded into Judicial custody on 03-10-2020 in connection with the case. However, he was released on bail by the Hon’ble Court on 18-12-2020.

On 13-05-2021 at about 08.40 pm, he uploaded a post on Social media (Facebook) stating as “Santhi Sanyungna yadrabo ohh!!!” (Could not work with cowdung, Cow Urine Ohhh!!!) “RIP Rashikhang Kangyet Hayeng nga chaani” (RIP Dry Argumentative person, will have fish tomorrow). This deliberately and wilfully insulted and outraged the religious feelings and sentiments of BJP workers and family members on the occasion of demise of their president of BJP Manipur Pradesh namely, late Professor S Tikendra Singh. This was in reference to the death of said leader due to COVID-19, said the affidavit.

The affidavit seeks HC to dismiss the writ petition for the ends of justice.
