ATSUM finance secy who hurled ‘abusive words’ at BJYM president granted anticipatory bail

While granting the bail, additional sessions judge FTC, Manipur East Reena Serto directed that in the event of arrest in connection with the matter, the petitioner shall be released on interim bail on furnishing a PR bond of Rs.20,000 only with one surety of the like amount on the condition that the petitioner shall not leave the State of Manipur without the prior permission of this court, shall cooperate with the investigating authorities and not influence prosecution witnesses.

A court of Manipur east on Tuesday granted anticipatory bail to finance secretary of All Tribal Students Union Manipur (ATSUM) Henkhokai Singsit who had allegedly hurled of abusive words at Bharatiya Janata Yuva Morcha Manipur (BJYM) president Barish Sharma and threaten him to “wring his neck” at Koubru if he dared to come.

While granting the bail, additional sessions judge FTC, Manipur East Reena Serto directed that in the event of arrest in connection with the matter, the petitioner shall be released on interim bail on furnishing a PR bond of Rs.20,000 only with one surety of the like amount on the condition that the petitioner shall not leave the State of Manipur without the prior permission of this court, shall cooperate with the investigating authorities and not influence prosecution witnesses.

The court called an objection report from the Imphal Police station, returnable on or before June 13, 2022.

In his pre-arrest bail application, Henkhokai Singsit through his counsel M Gunedhor submitted that recently based on a news which went viral in social media and other prints the conflicts between the groups of Bharatiya Janata Party youth wing Manipur unit and the villagers of Thanjing hills was cropped up.

As per the news report, it is alleged that the villagers of the said Thangjing hills i.e. the KUKI community have refused the entry of the BJYM members in the second week of May 2022. The BJYM claims that the Thanjing area is heritage site, they should be allowed to enter. However, the villagers denied them entry on the ground that they don’t have any rights whatsoever and even attempt to the plantation of the trees over the Thanjing hills. The villagers claimed that the prior permission has to be taken in this regard if they ever intend to enter the site. Following which there was a minor misunderstanding between the two said groups.

As per the viral and other news reports, it is alleged that the said BJYM wings/members have entered the Thanjing area with arms/weapons.

Following the incident, the BJYM circulated what they had face when they enter the Thanjing area at the hands of the KUKI community through video clippings and other means of communication in the 3rd week of May 2022. Whereas the villagers of the Thangjing Hills area accused BJYM members of misbehaviour and threatening and intimidation thereof. In which One Barish Sharma opined about the said situation through social media and to the same the present petitioner countermand by way of reciprocating against the statement given by the said Barish Sharma a member of BJYM, said the petitioner.

The petitioner highlighted news report published in Paonilkhol News Sangai Imphal on May 21 that Barish sharmana Luchingba Khutpu amana Thangling Chingda tha asigi 14 da khulai matik chana pairaga changsillaktuna khunjasingbu aki-akhang pokballamle: Kuki Chief Association

Reacting to the incident, the ATSUM Finance Secy had posted,”Barish Sharma, You dog of Biren, let’s meet and settle our accounts. Come to Koubru with your Haomee federation and Kangleipak kanna lup, we’ll wrong your necks,”

The petitioner submitted that on 24-05-2021 the personnel of Saparmeina Police Station turned up to his residence and informed the petitioner’s family that the petitioner should appear before it. And later on, at around 11:00 am another police team turned up stating the same to the family members of the petitioner.

They warned the petitioner’s wife for the untoward incident unless giving appearance by the present petitioner before the said Police Station or else he shall be arrested. Later on, it is learnt that a complaint has been lodged against him at Cyber Crime Imphal, Manipur in the last week of May 2022 in regards to the aforementioned facebook posts showing hurling of abusive words, submitted the petitioner, while praying for pre-arrest bail.
