With the Manipur government submitting that the Governor has taken decision on Election Commission of India’s opinion regarding disqualification of 12 BJP MLAs, the Supreme Court on Thursday reserved its verdict on a long-standing pending case relating to disqualification of 12 Parliamentary Secretaries of Manipur.
The State of Manipur told the SC that the Governor has passed a decision on the opinion given by the EC regarding the disqualification of 12 BJP MLAs of Manipur Assembly on the “office of profit” issue.
Counsel for the petitioner submitted that the writ petition has become infructuous as an order has been passed by the Governor of Manipur.
Accordingly, the SC Bench comprising Justice L Nageswara Rao, Justice B.R. Gavai and Justice B.V. Nagarathna disposed of the petition.
Later, the SC Bench made a final hearing on another petition regarding the disqualification of 12 parliamentary secretaries and reserved its judgement.
Earlier on November 9, the same bench of the SC observed that the Governor of Manipur cannot delay taking a decision on the opinion given by the Election Commission of India (ECI) regarding the disqualification of 12 BJP MLAs of Manipur Assembly in the “office of profit” issue.
The bench made this observation after noting that the Governor is yet to take a decision on the opinion furnished by the Election Commission on January 13, 2021.
The bench was hearing a writ petition filed by D D Thaisii, Congress MLA from Manipur, who sought for disqualification of these 12 MLAs on the ground that they were holding the posts of Parliamentary Secretaries, which amounted to “offices of profit”.
Following the court observation, Manipur Governor La Ganesan notified on December 8 that 12 MLAs are not holding office of profit and dismissed a complaint filed by DD Thaisii on disqualification of MLAs.
