Chief Secretary’s intervention sought “to control the pick and choose policy of assigning the junior most Additional Public Prosecutor to look after the charge of Deputy Director of Prosecution”
The Additional charge of looking after the work of Deputy Director of Prosecution given to a “junior most Additional Public Prosecutor” has courted controversy with five Sr Addl Public Prosecutors of the district and sessions courts of Manipur alleging favoritism and irregularities.
The five Sr Addl Public Prosecutors have submitted a letter to the chief secretary, government of Manipur, “to check into all the irregularities and unfairness in the Prosecution Department and to control the pick and choose policy of assigning the junior most Additional Public Prosecutor to look after the charge of Deputy Director of Prosecution”.
The Secretary (Law) had on February 24, 2021 issued an order wherein Addl Public Prosecutor Pukhrambam Dhanakumar who was posted at the District & Sessions Court, Thoubal was transferred to the Courts of Additional District & Sessions Judge (FTC), Manipur East and West with the additional charge of looking after the work of Deputy Director of Prosecution.
The five Sr Addl Public Prosecutors requested modification of the order issued by the secretary (law). “Such temporary and urgent arrangement should be done by choosing the senior most Additional Public Prosecutor in a fair and just manner, they said.
Sr Addl Public Prosecutors had already submitted a representation to the chief minister on January 22, 2021 through the concerned Minister (Law) requesting to give charge/appoint the senior-most Prosecutor as the Director of Prosecution as done in the past years. However, till date, no appointment or charge has been given, they said.
Alleging that the Secretary (Law)’s order clearly showed favoritism and irregularities, they said, “If at all, a look after is to be appointed at this juncture, due to urgency and need, it should be given to the senior most or to the most efficient Addl. Public Prosecutor.”
“There are seven Additional Public Prosecutors in Manipur and the said Additional Public Prosecutor is the youngest and his name is at serial No. 6 in the seniority list,” they said, pointing out that the said Additional Public Prosecutor has been transferred many times during a period of two years.
The five Sr Addl Public Prosecutors also claimed that, as per norm and rule, the appointment of Deputy Director is to be given to the senior most Addl Public Prosecutor or it is to be promoted from amongst the Assistant Public Prosecutor who has an experience of not less than ten years.
They alleged that the transfer, posting and look after charge of the Deputy Director was done whimsically by the Secretary (Law). “Such irregularities are happening in the Prosecution Department which needs your immediate intervention and attention,” they added.Sr Addl Public Prosecutors, irregularities, favoritism
